Types of Restraining Orders - Domestic Violence

For people who are family or household members, spouses, or have a child together.

Domestic Violence (Florida Statute 741.28) means any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment or any criminal offense resulting in physical injury or death of one family or household member by another who is or was residing in the same single dwelling unit. "Family or household member" means spouses, former spouses, persons related by blood or marriage, persons who are presently residing together as if a family or who have resided together in the past as if a family, and persons who have a child in common regardless of whether they have been married or have resided together at any time.

You may obtain a Domestic Violence Restraining Order against a husband, wife, ex-husband, ex-wife or a blood relative residing in the same household or any other person you are currently or were residing with as if you were a family. You may also obtain a restraining order against a person with whom you had a child, whether you are living together or not.

Domestic Violence Injunction applies to violence between:

  • Spouses or former spouses
  • Family members related by blood or marriage
  • Individuals who live or lived together as a family
  • Parents of a shared child

Includes assault, battery, sexual violence, stalking, kidnapping, or false imprisonment.
