Injunction Protection for Victims of Repeat Violence

For victims who have experienced two or more incidents of violence (or stalking) by the same person, where one incident occurred within the last six months.

Repeat Violence (Florida Statute 784.046) means two incidents of violence or stalking committed by the respondent, one of which must have been within 6 months of the filing of the petition, which are directed against the petitioner or the petitioner’s immediate family member. “Violence” means any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, or false imprisonment, or any criminal offense resulting in physical injury or death, by a person against any other person.

For an act of Repeat Violence, however, you may file for a restraining order against anyone. There must have been two (2) occurrences or acts of physical abuse; one of which must have must have been in the last six (6) months. The Judge may require you to furnish the police reports as filed.

Types of Restraining Orders - Repeat-Violence
Injunction for Protection Against Repeat Violence applies to violence between:
  • Two (2) acts of violence
  • One must have occurred within the last 6 months
  • Can be filed against any individual
  • Police reports may be required
